Selling, Buying or Refinancing A Home?

The purchase, sale or refinancing of your home may be the your largest financial transaction this year.  Surprisingly, many people sign real estate contracts or loan agreements without first receiving legal advice.  When presented with what is described as a "form contract" it is easy to forget that the "form" contains binding terms and conditions that may not serve your interests.  At Counselors Title Company LLC ("Counselors Title"), we believe no one should undertake a real estate or loan transaction without legal representation.

Of course, we also understand that no one likes to pay legal fees.  What if you could receive legal representation in your real estate transaction at little or no cost to you?

The sale or refinancing of your home usually results in a premium for title insurance paid for by the seller or the buyer, or in a refinance, the borrower.  Title insurance protects a buyer or lender from claims against the property not discovered until months or years after the closing.  The buyer or lender looks to the title insurance underwriter to cure the title defect or pay damages up to the amount of the title policy.  A title company retains a portion of the premium for searching and examining title and issuing the title policy and closing the transaction.

However, the title company is not permitted to provide legal advace to any party in the transaction.  For example, the title company cannot prepare your contract, advise you as to your rights under the contract, or represent you in resolving any issues or disputes that may arise during the transaction.

If you are obligated to provide title insurance in the transaction, and you select Counselors Title, a real estate attorney with one of the affiliated firms will provide legal representation at no charge to you.  You receive legal representation from the law firm and title services from Counselors Title, yet you only pay the charges typically charged by a title company.  There are some limitations.  If a dispute arises in the transaction that results in litigation, there would be additional legal fees.  However, in a routine transaction, you should not incur any additional charge or fee other than the costs typically incurred with any title company.

If you have to pay for title insurance in your real estate transaction, you have the right to select the title company.  Counselors Title will provide professional, efficient, friendly and reliable closing services and the affiliated law firm will provide legal representation.  So, before you sign, get Counselors on the line!
